Councilors Present: Stephen Moriarty, Jeff Porter, Peter Bingham, Harland Storey, Mark Kuntz & Donna Damon
Call to order in the Council Chambers at Cumberland Town Office at 6:30 p.m.
Councilor Bingham moved to enter into Executive Session to discuss Land Acquisition.
Second by Councilor Kuntz

Councilor Bingham moved to come out of Executive Session at 7:10 pm

WORKSHOP Town Attorney Proposed Use Agreement SAD #51 - Twin Brook Recreation Area
Councilors met with Town Attorney Ken Cole and Recreation Director Bill Landis to discuss the Proposed Use Agreement. Chairman Moriarty and Councilors authorized the Town Attorney to negotiate with the SAD #51 attorney to draft an agreement between the MSAD #51 and Town regarding Twinbrook Recreation Area. Town Attorney said that he will return with a draft resolution to be reviewed by the Town Council.

01-74 To act on request of James Guidi to reduce speed limit to 35 mph on Route 1 -
northern office commercial zone
Town Manager relayed the phone conversation he had with James Guidi in regards to speed limit concerns in the vicinity of the Toddle Inn and CTC parking area on Route 1. Town Manager recommended the Council refer this issue to the Maine DOT for further evaluation.
Councilor Storey moved to refer to the Maine DOT for a recommendation to consider reducing the speed limit to 40 mph from Yarmouth town line south to Tuttle Road
Second by Councilor Porter.

Councilor Kuntz moved to refer to the Maine DOT for recommendation to consider
reducing the speed limit to 40 mph from the Yarmouth town line to 300 yards south CTC parking lot.

01-75 To set date for Public Informational Meeting DEP Site Location Development Act Permit Twin Brook Recreation Area
Town Manager recommended October 4, 2001 at 7:00 pm which can be held by the Town Staff or the Town Council.
Councilor Bingham moved to hold the Public Informational Meeting on October 4, 2001 at 7:00 pm in the Town Council Chambers.
Second by Councilor Kuntz.
Vote: UNANIMOUS (6)
01-76 To appoint members of Stone Wharf Committee
Councilor Damon said that she is still seeking prospective members however, proposed that we nominate the candidates who have so far applied, adding Bob Libby to represent the CTC.
Councilor Bingham moved to nominate the following to serve on the Stone Wharf Committee: Linden Smith, Winthrop Houghton, Sr., Milton Calder, Peter Rice, Ernest Burgess, Michael Porter, Malcome Rice, Allen Malony, Martha Hamilton, Nelson Stevens, A.E. (Tad) Runge, Sam Ballard, Bob Libby (CTC Representative), Ted Curtis (Harbormaster), Councilor Peter Bingham (Ex-officio), Councilor Donna Damon (Ex-officio), and Chairman Stephen Moriarty (Ex-officio).

Councilor Kuntz/Council - Cumberland County Budget & letters from the towns of Cape Elizabeth and New Gloucester.
Councilor Porter said that the nominating committee is moving forward to the interview phase of committee and board selection process.
Councilor Damon thanked Chairman Moriarty for conducting the past meeting on Chebeague Island to discuss the Growth Management Ordinance issues.
Councilor Storey thanked Councilor Kuntz for explaining the County Budget process; also thanked the Cumberland Fire Department for reaching out to the community for assistance in a fund drive for the victims of the New York City tragedy.
Chairman Moriarty reminded the Council of the Yarmouth invitation on Oct 3rd. He announced that since adopting the Impact Fee Ordinance, the town has collected $8800.
