ACTION MINUTES
Cumberland Town Council Meeting
October 6, 2003
6:00 p.m. - EXECUTIVE SESSION re: Personnel Issue
Attendance: Chairman Porter and Councilors Moriarty, Stiles, Storey, and Kuntz were present. Councilors Damon and Savasuk arrived at 6:15 p.m.
Chairman Porter opened the meeting at 6:00 p.m. and requested a motion to move into executive session, explaining the council will reconvene the meeting at 7:00 p.m.
Motion by Councilor Stiles to recess to Executive Session to discuss personnel issues,
namely the six-month evaluation of the Town Manager;
Seconded by Councilor Moriarty.
VOTE: UNANIMOUS 5-0 (Councilors Damon and Savasuk out)
7:00 p.m. - Reconvene
Motion by Councilor Stiles to reconvene the regular Town Council meeting at
7:00 p.m.;
Seconded by Councilor Moriarty.
VOTE: UNANIMOUS 7-0 (all present)

Motion by Councilor Moriarty to incorporate into the minutes the proposed changes
as suggested by Councilor Damon, with the exception of any correction to Councilor
Savasuk's comments;
Seconded by Councilor Stiles.
VOTE: UNANIMOUS 7-0

03 100. To hold a public hearing to consider and act on the renewal application by
Chebeague Island Hall Community Center for a Bottle club Registration and
Special Amusement Permit for the period August 2003 through August 2004.
Motion by Councilor Damon to grant the license to Chebeague Island Hall
Community Center with the stipulation that at any event at which alcohol will
be consumed will require the presence of a police officer;
Seconded by Councilor Stiles.
VOTE: 6-1 (Councilor Kuntz)
03 101. To hear a report from Cumberland Fire Chief, Dan Small, regarding an amendment to the sprinkler policies presently enforced through the Cumberland
Subdivision Ordinance.
Motion by Councilor Moriarty to schedule a workshop with the Planning Board at
the next available date to begin to get into this with some detail and to determine
what the towns policy ought to be with regard to comprehensive fire protection
issues for residential structures and new commercial structures;
Seconded by Councilor Stiles.
VOTE: UNANIMOUS 7-0
03 102. To receive a request for a Contract Zone for a branch office of the Town and
Country Credit Union to be located at the former Bowdoin Medical Building,
342 Main Street.
Motion by Councilor Stiles to deny the request by Town and Country Credit Union
for a Contract Zone for property located at 342 Main Street;
Seconded by Councilor Storey.
VOTE: PASSAGE 5-1-1 (Chairman Porter opposed; Councilor Moriarty
abstained)
03 103. To adopt updated maximums to the MMA General Assistance Ordinance for the
period of October 1, 2003 through October 1, 2004.
Motion by Councilor Damon to adopt the maximum revisions known as Appendixes
A through C of the MMA Model General Assistance Ordinance for the period of
October 1, 2003 through October 1, 2004;
Seconded by Councilor Stiles.
VOTE: UNANIMOUS 7-0
03 104. To authorize the Town Manager to enter into an agreement with the Town of
Falmouth for the connection to the Falmouth Municipal Sewer System of
Cumberland homes within the Falmouth Country Club and located on Hazeltine,
Turnberry, Muirfield and Birkdale Roads.
Motion by Councilor Moriarty to authorize the Town Manager to enter into an
Agreement with the Town of Falmouth for the connection to the Falmouth
Municipal Sewer System of Cumberland homes within the Falmouth Country
Club and located on Hazeltine, Turnberry, Muirfield and Birkdale Roads;
Seconded by Councilor Damon.
VOTE: UNANIMOUS 7-0
03 105. To authorize the Town Manager to enter into an agreement with MDOT for a
Locally Administered Project (LAP) known as the wharf-head at Cousins Island,
Yarmouth.
Motion by Councilor Moriarty to authorize the Town Manager to enter into an
agreement with MDOT for a Locally Administered Project known as the
wharf-head at Cousins Island, Yarmouth;
Seconded by Councilor Stiles.
VOTE: UNANIMOUS 7-0
03 106. To authorize the Town Manager to enter into a license agreement with Mr. Bob
Waterhouse for property located at 197 Range Road, and known as Map R5,
Lot 30.
Motion by Councilor Stiles to authorize the Town Manager to enter into a license
agreement with Benjamin A. Waterhouse for property located at 197 Range Road
and known as Map R5, Lot 30;
Seconded by Councilor Kuntz.
VOTE: UNANIMOUS 7-0
